Generally speaking, in Virginia, the portion of the Va Code relating to descent and distribution applies when:
a. The decedent left no will,
b. The decedent's will is denied probate (e.g., will not properly executed, or will successfully contested by decedent's heirs), or
c. The decedent left a will but the will does not make a complete disposition of the estate (resulting in a "partial intestacy").
In Va, the same intestate succession rules apply to real property and personal property. Persons who inherit property by intestate succession are called heirs. Persons who take property under a will are called beneficiaries (or legatees, or devisees).
